FERPA Release

Release to share your college and work-related information and records.

1. Purpose

Unmudl Public Benefit Corp. ("Unmudl") and its Affiliates are committed to protecting the privacy of learner education records in compliance with the Family Educational Rights and Privacy Act (FERPA). This policy outlines how Unmudl handles learner data, including collection, use, disclosure, and security, in accordance with FERPA regulations which can be found here.

2. Scope

This policy applies to all learners, educational institutions, employers, and third-party partners who interact with Unmudl’s platform and services.

3. Your Education Records at Unmudl Under FERPA

In compliance with the federal Family Educational Rights and Privacy Act of 1974 (FERPA), Unmudl and its Affiliates are prohibited from providing Personally Identifiable Information (PII) from your learner records to potential employers and other colleges (in addition to the college noted as a sponsoring college for your course(s)) in the Unmudl network. This includes information  such as course progress, course schedule, and other learner record information.

You may, at your discretion, grant Unmudl permission to release information about your records to potential employers and other colleges in the Unmudl network by agreeing to this learner Information Release Authorization for FERPA. The specified information will be made available only if requested by a potential employer and other colleges through America’s Community and Technical College Network.

Unmudl may receive, store, and process education records from partner colleges, training providers, or learners. These records may include:

Course progress and completion information
3.2.
Demographics (i.e., gender, race/ethnicity)
3.3.
Contact Information (i.e., address, phone number)
3.4.
Job search activity status
3.5.
Profile information regarding your skills
3.6.
Resume included in your profile
3.7.
Current and future employment information
3.8.
IDs in Unmudl, employer, college, and college systems
3.9.
Other: Course progression information, attendance information, completion information, and any other course/program information requested by a potential employer and other colleges in the Unmudl Network.

4. Definition of Personally Identifiable Information (PII)

Personally identifiable information (PII) for education records is a FERPA term referring to identifiable information that is maintained in education records and includes direct identifiers, such as a student’s name or identification number, indirect identifiers, such as a student’s date of birth, or other information which can be used to distinguish or trace an individual’s identity either directly or indirectly through linkages with other information.

PII includes, but is not limited to:
4.1.
The learner's name (YOU)
4.2.
The name of the learner's parent or other family members;
4.3.
The address of the learner or learner's family;
4.4.
A personal identifier, such as the learner's social security number, learner’s ID number, or biometric record;
4.5.
Other indirect identifiers, such as the learner's date of birth, place of birth, and mother's maiden name;
4.6.
Other information that, alone or in combination, is linked or linkable to a specific learner that would allow a reasonable person in the school community, who does not have personal knowledge of the relevant circumstances, to identify the learner with reasonable certainty; or
4.7.
Information requested by a person who the educational agency or institution reasonably believes knows the identity of the learner to whom the education record relates.

5. Your Rights Under FERPA

Learners have the following rights under FERPA:
5.1.
Right to Access: learners can request access to their education records.
5.2.
Right to Request Amendment: learners can request corrections to inaccurate or misleading information.
5.3.
Right to Consent to Disclosures: Unmudl will not disclose education records without learner consent, except in cases permitted by FERPA.
5.4.
Right to File a Complaint: learners can file a complaint with the U.S. Department of Education for FERPA violations.

6. Your Automatic Consent Because You Choose to Use Unmudl

Per FERPA regulations, educational providers can share learner education records for administrative and reporting purposes with school officials who have a legitimate educational interest. Unmudl offers courses in partnership with community and technical colleges across the US. In order to facilitate your enrollment, and outcomes from courses, we will require your release of information. Unmudl may disclose education records without learner consent in the following cases:
6.1.
To Partner Educational Institutions providing courses or training through Unmudl.
6.2.
To Employers Participating in Workforce Programs if the learner has explicitly opted in.
6.3.
To School Officials with Legitimate Educational Interests, including faculty or administrators at partner institutions.
6.4.
To Comply with Legal Obligations, such as court orders or subpoenas.

7. Data Protection & Security Measures

Unmudl employs strict data security measures, including:
7.1.
Encryption of stored and transmitted learner records.
7.2.
Access Controls to restrict data access to authorized personnel.
7.3.
Regular Security Audits to ensure FERPA compliance.

8. Learner Opt-In for Employer Connections

By agreeing to these terms, you agree to release your learner records to sponsoring colleges and potential employers in the Unmudl Network who might be interested in hiring you. Please note that your authorization to release information has NO EXPIRATION DATE; however, you may revoke your authorization at any time by unchecking the box. Unmudl connects learners with employers seeking skilled workers through its job search function. To comply with FERPA:
8.1.
Learners must explicitly opt in before their information is shared with employers.
8.2.
Unmudl will provide clear consent forms explaining what data will be shared and how it will be used.
8.3.
learners can revoke consent at any time.

9. Compliance & Training

9.1.
Unmudl provides FERPA training to employees and partners handling learner records.
9.2.
Employees who violate FERPA policies are subject to disciplinary action.
